Chatib strictly respects the intellectual property rights of artists, creators, and copyright holders. In comprehensive compliance with the Digital Millennium Copyright Act ("DMCA") and other applicable international copyright laws, we have established the following policy to promptly address and resolve any claims of copyright infringement occurring on our main chat platform.
1. Submitting a DMCA Takedown Notice
If you are a copyright owner, or an authorized agent thereof, and you possess a good faith belief that any content hosted on or transmitted through Chatib infringes upon your copyrighted work, you may submit a formal notification pursuant to the DMCA. To be valid, your notice must be sent to our Designated Copyright Agent and must include the following information in writing:
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the Copyrighted Work: A detailed description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the Infringing Material: Clear identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit our administrators to locate the material (e.g., specific URLs, room names, timestamps, and usernames).
- Contact Information: Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
- Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Designated Copyright Agent Contact
All DMCA Takedown Notices must be directed to our Designated Copyright Agent via our Contact Us page, or sent directly via email to: [email protected] with the strict subject line: "URGENT: DMCA Takedown Notice".
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to severe liability for damages.
3. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Chatib has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the access of users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the platform and/or permanently ban the IP addresses of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
4. Counter-Notice Procedure
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner to post and use the material, you may send a counter-notice to our Copyright Agent containing: your signature, identification of the removed material and its previous location, a statement under penalty of perjury regarding your good faith belief that it was removed by mistake, and your contact details consenting to jurisdiction.
